General Terms and Conditions of Sale

Preamble

These general terms and conditions of sale ("GTC") apply to any use of the website by a Client ("the Client") for the booking of any accommodation and services in a Country House, through the following channels

- On the website https://www.lesmaisonsdecampagne.com/ ("the Site");

- By telephone or by e-mail to the Maison de Campagne;

- On site at the reception of the Maison de Campagne,

- Through Partners.

La Maison de Campagne reserves the right to adapt or modify these general terms and conditions of sale at any time. The general terms and conditions of sale applicable to a reservation are those published on the Site on the date the reservation is made.

The GTCs may be supplemented by the conditions of sale of the fare booked, which are expressly mentioned in the description of the fare selected at the time of booking on the Site. The Client must confirm by ticking the box that he has read and accepted these GTC and the conditions of sale of the fare booked before definitively confirming his booking; no booking is possible without this agreement.

For all other booking methods, the Client will receive the GTC, the Terms and Conditions of Sale for the fare booked and the Privacy Policy in response to their booking request. Confirmation of the booking by the Client implies full and unreserved acceptance of their provisions.

The following information is available on the Site and within the reservation system:

- The legal mentions

- The essential characteristics of the accommodations offered by the Maison de Campagne

- The essential characteristics of the complementary and optional services offered

- Prices include all taxes

- The conditions of sale of the reserved tariff, the period of validity of the offers and the price of the offers;

- Payment terms,

- The present GTC.

All the information provided on the Site is presented in French as well as in English.

All Clients acknowledge that they have the capacity to contract, i.e. that they are of legal age and are not under guardianship or tutelage.

Definitions

 The terms below have the following meaning:

 "Booking Confirmation": a dematerialised document sent to the Client to inform them that their booking has been taken into account, which summarises the characteristics of the accommodation and services booked by the Client.

"Customer" means a natural person acting exclusively for his own personal needs.

"Booked Rate Terms and Conditions" means the price applied on the date selected by the Client for a category of room with or without services, together with its payment terms and cancellation terms.

"Country House": refers to the Maison de Campagne-Villiers-le-Mahieu (SAS Château de Villiers le Mahieu - RCS Versailles 319225785) or the Maison de Campagne - Maison du Val (SH Château du Val - RCS Versailles 888277829).

"Partners" means any service provider or partner who has entered into a service contract or partnership agreement with the Country House operator.

"Site" means the https://www.lesmaisonsdecampagne.com/ website.  

Object

The present general conditions define the rights and obligations of the Client and the Maison de Campagne. They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties.

The Customer acknowledges having read and accepted these general terms and conditions of sale and the Terms and Conditions of Sale of the reserved rate.

Reservation

 The Client chooses his accommodation and services from among those offered by the Maison de Campagne according to his needs.

 The Client acknowledges that he/she has taken cognisance of the nature, price, destination and booking conditions of the accommodation and services and has requested and obtained the necessary and/or additional information, in particular the Conditions of Sale of the reserved fare, in order to make the booking with full knowledge of the facts.

For any privatisation of space within the Maison de Campagne, a contact form is available on the Site in the "Book" tab, "Privatise a space".

For any reservation of more than 5 rooms, the Customer must contact the Maison de Campagne by telephone or by e-mail (for the Maison du Val: loisirs-mdv@lesmaisonsdecampagne, for the Château de Villiers-le-Mahieu: loisirs-vlm@lesmaisonsdecampagne.com) in order to obtain the preferential group rate and the conditions of sale of this rate and to proceed with the reservation. In the event that the Customer has made more than 5 consecutive reservations on the Site for the same length of stay, the Maison de Campagne reserves the right to cancel said reservations and to contact the Customer directly.

The Client is solely responsible for the choice of accommodation and services and their suitability for his/her needs, so that the responsibility of the Maison de Campagne cannot be sought in this respect.

The booking is deemed to be accepted by the Client at the end of the booking process.

All bookings are nominative and may not be transferred to a third party, whether free of charge or in return for payment. Any reservation made for a third party must be made in the name of the third party holding the holiday.

Booking process

The reservation made by the Client is made directly:

- online on the Site;

- by phone or by email to the Maison de Campagne;

- on site at the reception of the Maison de Campagne ;

- through Partners.

The booking request is confirmed upon receipt by the Client of the Booking Confirmation, sent by the Guest House or the Partner.

At the time of booking, the Client must provide a number of mandatory details, including certain personal details necessary to process the booking. The Client must also indicate the number of persons benefiting from the services, as well as their age, any minor over the age of 13 being considered an adult.

The Client attests to the truthfulness and accuracy of the information provided.

The booking process includes the following steps:

- Step 1 - Choosing the dates and number of participants

- Step 2 - Choice of the room and the Terms and Conditions of the reserved rate,

- Step 3 - Selection, if applicable, of one or more proposed complementary services,

- Step 4 - Presentation of the summary of the reservation, its total price, the terms and conditions of sale of the reserved rate, which includes in particular the payment and cancellation conditions, modifications if necessary of the choice of services (date, room, rate, additional service), and information concerning the tourist tax if applicable,

- Step 5 - Mandatory provision of contact details by the Client, and optional provision of name/first name/age of room occupants and special requests,

- Step 6 - On the Site, the Client confirms, by ticking the box, that he/she has read and accepts the GTC, the Terms and Conditions of Sale of the fare booked as well as the privacy policy before definitively validating his/her reservation; no reservation is possible without this agreement.

- Step 7 - Provision of credit card numbers in the event of a guarantee or pre-payment request,

- Step 8 - Confirmation and validation of the reservation and payment by the Client. Entering the bank details constitutes the Client's acceptance and has the effect of contractually committing the Client to the Maison de Campagne.

- Step 9 - Receipt by the Client of the booking confirmation email. This email summarises the date of the booking, the services booked, the prices with details of any applicable taxes, the terms and conditions of sale of the rate booked (including cancellation conditions), accepted by the Client, the link to consult these GTC and the privacy policy as well as the address of the Maison de Campagne reserved. If the Client does not receive the confirmation email within 24 hours of the booking, it is the Client's responsibility to contact the Maison de Campagne in order to ensure that the information provided is correct and that the booking is taken into account.

Cancellation or modification

The Customer is reminded, in accordance with Article L. 221-28 12° of the Consumer Code, that he/she does not have the right of withdrawal provided for in Article L. 221-18 of the Consumer Code.

The Conditions of Sale of the rate booked and accepted by the Client specify the terms and conditions for cancelling and/or modifying the reservation. If the Client opts for a flexible rate, he/she must take all the necessary measures so that the Maison de Campagne can debit his/her bank card for the amount of the reservation remaining to be paid as from the end of the period open to the Client for the cancellation of his/her reservation and cannot oppose this. In the event that payment by the Client has not been made despite reminders from Maison de Campagne, Maison de Campagne may cancel the reservation and retain the deposit paid by the Client.

Reservations with prepayment for a non-refundable and non-cancellable rate cannot be modified and/or cancelled. No refunds will be given for the interruption of a stay in the case of a pre-paid booking for a non-refundable and non-cancellable rate.

Where the Terms and Conditions of Sale of the rate booked allow, the cancellation or modification of a booking made from the Site can be made directly on the link in the Booking Confirmation "Modify or cancel a booking" by entering the booking reference and the pin code indicated in the booking confirmation e-mail, or with the Maison de Campagne. For bookings made directly with the Maison de Campagne at the reception or by telephone, cancellation or modification can only be made with the Maison de Campagne.

The conditions of cancellation and the consequences of the Client's no-show at La Maison de Campagne are specified in the Conditions of Sale of the reserved tariff.

Stay at the Maison de Campagne

All guests staying at the hotel must present a valid form of identification at check-in.

Foreign customers, including accompanying persons and adolescents over 15 years of age, must complete an "individual police form". Children under 15 years of age may appear on the card of an accompanying adult. The information contained in these forms is governed by Article R.611-42 of the Code de l'entrée et du séjour des étrangers et du droit d'asile.

 The Client may not introduce third parties into the room without the express permission of the Maison de Campagne, which reserves the right to carry out all necessary checks.

Only guide or assistance dogs are allowed in the Maison de Campagne.  

The Client accepts and undertakes to use the room as well as the common areas at his/her disposal in a reasonable manner. Any behaviour contrary to the principles of safety and/or hygiene, good morals and/or public order may lead the Maison de Campagne to ask the Client to leave the establishment, without refund.

Any damage caused by the Client or by the occupants of the room or in the various areas occupied by the Client during his stay may be directly invoiced to the Client for the cost of repairing the damage, which must in any event be reported to the reception of the Maison de Campagne.

The items of room equipment (excluding consumables) provided to the Client such as towels, bathrobes, carafes, coffee machines, kettles, etc. are the property of the Maison de Campagne. In the event that Maison de Campagne notices their absence after the handover of the room by the Client, these items may be invoiced by Maison de Campagne to the Client.  

For safety reasons and out of respect for everyone, smoking is strictly forbidden in the Maison de Campagne. In accordance with the Public Health Code, which sets out the conditions for the application of the ban on smoking in places used by the public, smoking in the Maison de Campagne exposes the Client to the fine provided for third class offences.

Penalties of up to the price of the room booked may be applied if the Client fails to comply with the no-smoking sign in the room.

If the Client does not check out at the time indicated in the Terms and Conditions of the reserved rate, he will be charged an additional night.

The hotel may ask the Client, upon arrival, for a security deposit or a pre-authorization to debit the credit card provided by the Client (no debit will be made) in the amount of 150 euros, which will be used in the event of any damage observed, without prejudice to all other rights and recourses. This pre-authorization will be cancelled upon the departure of the Customer in the absence of damage or loss.

Responsibility

The photographs presented on the Site are not contractual. Although every effort is made to ensure that the photographs, graphics and texts reproduced to illustrate the Maison de Campagne give as accurate an idea as possible of the accommodation services offered, variations may occur, particularly due to changes in furniture or possible renovations. The Client may not claim any compensation for this.

In accordance with the laws and regulations governing intellectual property rights, the use and/or reproduction of all or part of the elements making up the Site's offerings are strictly prohibited.

Any booking or payment that is irregular, inoperative, incomplete or fraudulent for any reason attributable to the Client will result in the cancellation of the booking at the Client's expense, without prejudice to any civil or criminal action against the Client.

The Maison de Campagne reserves the right not to receive or to expel, without refund, the Client whose dress is inappropriate, indecent and/or negligent, the Client whose behaviour is noisy, improper or alcoholic, the Client whose behaviour is contrary to hygiene, good morals and public order. Proper dress is required in the restaurants and in the public areas of the Maison de Campagne. The Client must be courteous and respectful towards the staff of the Maison de Campagne. On pain of exclusion without refund, the Client shall refrain from any verbal or physical violence, any racist behaviour or remarks as well as any form of harassment.

Awards

Prices for accommodation and services are communicated before and at the time of booking.

The prices quoted are per room for the number of persons and date(s) selected and the total cost of the booking will be shown on confirmation of the Client's booking. The prices include the VAT applicable on the day of the reservation and any change in the VAT rate will be automatically reflected in the prices indicated on the date of the invoice.

The prices are confirmed to the Customer inclusive of all taxes (TTC), in the commercial currency of the Maison de Campagne (the Euro). The prices communicated are only valid for a specific period of time.

The tourist tax and any other taxes specific to the municipalities indicated for each rate are not included in the advertised rate and must be paid directly to the hotel at check-in or check-out.

For the Maison de Campagne - Maison du Val, the tourist tax is €7.25 per adult per night. For the Maison de Campagne - Château de Villiers le Mahieu, the tourist tax is €7.56 per adult per night.

Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated on the date of the invoice. Indeed, the rates may be increased by different taxes depending on the city/country. These taxes will be communicated to the Client at the time of booking, if they are known to the Maison de Campagne at that time. If not, they will be displayed at the reception of the Maison de Campagne. The Client undertakes to pay the various taxes, without any dispute, to the Maison de Campagne.

La Maison de Campagne guarantees that the best rates are offered on the Site. If, after having booked on the Website, the Client finds within 24 hours of his booking an equivalent offer for the same date(s), at a lower rate, the same number of persons and the same type of room, the same services with the same conditions of sale (cancellable or not, refundable or not) on another website, including tourist tax and administration costs, La Maison de Campagne guarantees this rate with an additional 10% discount.

Payment

The Client provides his payment details either (i) to prepay the booking before the stay or (ii) as a guarantee for the booking in case of a "no show".

In the case of a bank card, the information required is: the bank card number, the date of validity (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram in the case of a prepayment.

All booking steps are secured using Secure Socket Layer (SSL) technology. Client information is encrypted and protected through server authentication and data stream encryption. The security certificate used is issued by the accredited third party company Sectigo and used by the D-Edge booking system. In addition, the booking system is hosted in a secure server environment with biometric security, firewalls and other advanced technologies to prevent interference and intrusion.

The Client's payment card is subject to security checks (credit check, card country check, IP address country check) by the designated partner and may be refused for several reasons: stolen or blocked card, ceiling reached, input error etc. In the event of a problem, the Client must contact his bank on the one hand, and the Maison de Campagne on the other, to confirm his reservation and method of payment. The means of online payment available and communicated may be Visa and Mastercard, American Express. This list is subject to change.

In the event of payment to the Maison de Campagne, the latter may accept different means of payment (cash), but the Customer must present the bank card used to guarantee the reservation or make the prepayment to the Maison de Campagne in order to verify the Customer's identity. La Maison de Campagne may also ask the Customer to show proof of identity in order to prevent credit card fraud.
Cheques are not accepted at Les Maisons de Campagne.

At the time of pre-payment, the amount that is debited at the time of booking includes: the price of the stay (including accommodation, taxes related to accommodation, the price of catering, taxes related to catering) and any other additional services selected by the Client, excluding tourist tax and/or any other tax that may be due as a result of the Client's stay in the Country House.

Personal data

Under the present terms, it is agreed that the Maison de Campagne is responsible for processing within the meaning of the applicable regulations, i.e. Regulation (EU) 2016/679 of 27 April 2016, known as the General Data Protection Regulation (GDPR), and Law No. 78-17Informatics and Freedoms in its updated version. 

In this respect and within the framework of the contract which binds us, the Maison de Campagne undertakes to process the personal data entrusted by the Customer in compliance with the provisions of the RGPD and in accordance with its data protection policy available here.

In accordance with the French Consumer Code, consumers who do not wish to be the subject of commercial canvassing can register free of charge on the government's Bloctel telephone opposition list.

Evidence agreement

Entering the required banking information, as well as accepting the Terms and Conditions of Sale for the rate booked, constitutes acceptance of the hotel contract between the parties, having the same value as a handwritten signature.

Computerized registers stored in MEWS SYSTEMS' computer systems will be kept in reasonable conditions of security and will be considered as proof of communications, orders and payments between the parties.

Force majeure

Neither party shall be liable to the other party in the event of non-performance of its obligations resulting from force majeure.

It is expressly agreed that force majeure suspends the performance of the parties' mutual obligations and that each party shall bear the costs arising from it.

Cases of force majeure are those usually recognised by the case law of the Cour de cassation.

In the event of force majeure or any other exceptional event that prevents Maison de Campagne from providing the room reserved for the Client, Maison de Campagne may offer accommodation in a hotel of at least an equivalent category or, if it is of a lower category, a room of a higher standard than that originally reserved, for services of the same nature. Any additional costs associated with this accommodation, for services of the same nature, will be borne by the Maison de Campagne.

In the event that the Client does not agree to the relocation or that it is impossible to implement, the Client may agree with La Maison de Campagne to postpone his/her stay or, failing agreement between the parties, cancel his/her reservation, which will then give rise to an immediate refund.

Anticipation

The GTC expressly exclude the legal regime of unforeseeability provided for in Article 1195 of the Civil Code. La Maison de Campagne and the Client therefore each waive the right to invoke the provisions of Article 1195 of the Civil Code and the unforeseeable circumstances provided for therein, undertaking to assume their obligations even if the contractual balance is upset by circumstances that were unforeseeable at the time of the conclusion of the contract, even if their execution proves excessively onerous, and to bear all the economic and financial consequences thereof.

"Cancellation & Interruption Insurance

The customer has the possibility to take out cancellation insurance with SafeBooking - Gritchen. This option is offered to him during the booking process. The terms and conditions of subscription and guarantee are available here : FR/EN.

Applicable law

The GTC are governed by French law.

Maison de Campagne informs the customer of the possibility of having recourse to a conventional mediation procedure or any other alternative dispute resolution method in the event of a dispute relating to these GTC, under the conditions set out in Title I of Book VI of the French Consumer Code.

After having contacted the Maison de Campagne customer service department (Villiers le Mahieu: accueil-vlm@lesmaisonsdecampagne.com/Maison du Val: accueil-mdv@lesmaisonsdecampagne.com) to try to resolve the dispute amicably, and in the event of a negative response or the absence of a response within sixty (60) days from the date of referral, the customer may refer the matter to the Médiateur Du Tourisme et du Voyage by e-mail using the referral form available on the website www.mtv.travel or by post to the following address:

Integral

The GTC, the Terms and Conditions of Sale of the fare booked by the Client, and the booking confirmation express the entirety of the parties' obligations.

No general or specific conditions communicated by the Customer may be incorporated into the GTC.

In the event of any inconsistency between the Booking Confirmation containing the Terms and Conditions of Sale for the fare booked and the GTC, the provisions set out in the Booking Confirmation shall prevail.
