La Clé des Champs Terms and Conditions

Preamble

The purpose of these general terms and conditions (hereinafter the "General Terms and Conditions") is to govern the rights and obligations of members of the "La Clé des Champs" loyalty program (hereinafter the "Members") and the companies :

• Château de Villiers le Mahieu, a société par actions simplifiée (simplified joint stock company), with its registered office at Château de Villiers le Mahieu 78770 Villiers le Mahieu, registered with the Versailles Trade and Companies Registry under number 319 225 785 (hereinafter "Château de Villiers le Mahieu");
• SH Château du Val, a société par actions simplifiée (simplified joint-stock company) with its head office at Château du Val, Route forestière de Brancas, 78100 Saint-Germain-en-Laye, registered in the Versailles Trade and Companies Register under number 888 277 829 (hereinafter the "Maison du Val");
  

Hereafter referred to as "Les Maisons de Campagne",

Definitions

The terms below have the following meaning:

"Clé des Champs" refers to the loyalty program described in the General Terms and Conditions;

"Maisons de Campagne" means both Château de Villiers le Mahieu and Maison du Val;

"Maison de Campagne" refers to the Château de Villiers le Mahieu or the Maison du Val;

"Member(s)": refers to members of the La Clé des Champs loyalty program who have enrolled;

"Site": refers to the https://www.lesmaisonsdecampagne.com/ website

Purpose and scope

The purpose of these terms and conditions is to govern the rights and obligations of Members and Maisons de Campagne.

The current General Terms and Conditions are available on the Site at any time.

Members are expressly informed that these Terms and Conditions do not govern :

• use of the Site, which is governed by the Site's General Conditions of Use, available here ;
• booking a stay, which is governed by the General Terms and Conditions of Sale, available here.
  

Membership of Clé des Champs is free of charge and entitles the Member to benefits based on the number of stays at Maisons de Campagne booked directly with Maisons de Campagne via the Site, by telephone or by e-mail.  

Membership

Membership of La Clé des Champs is open to all persons aged at least eighteen (18) who have the legal capacity to enter into a contract under French law and who are consumers as defined by consumer law (i.e. any natural person acting for purposes that do not fall within the scope of his or her commercial, industrial, craft, liberal or agricultural activity).

To become a member, the future member must first fill out a form on the Site or at the Maisons de Campagne reception desk, in which he or she must expressly accept the General Terms and Conditions, which he or she will have read beforehand. Failing this, membership cannot be finalized.

Members are also advised to check the box to receive Maisons de Campagne newsletters in order to be kept informed of Maisons de Campagne events and news.

He will have to provide the following necessary and compulsory elements, namely :

• Name
• First name
• E-mail address
  

A valid individual e-mail address is required to join La Clé des Champs. The same e-mail address may not be used by several Members.

Les Maisons de Campagne reserves the right to ask the Member to confirm, by any appropriate means, his/her identity and the information communicated.

It is expressly stated that the loyalty program is entirely paperless. Therefore, no physical medium (e.g. a loyalty card) will be given or transmitted to the Member at the time of enrolment.

Loyalty levels :

The loyalty level is defined according to the number of stays made by the Member in the Maisons de Campagne and booked directly with the Maisons de Campagne, via the Website, by telephone or by e-mail, during each reference period:

• Level 1: Budding Epicureans: from two stays,
• Level 2: Curious Explorers: from three stays,
• Level 3: Les grands échappés: from four stays,

The first reference period is defined as follows:

• In the event that enrolment takes place between September¹ and December 31 of year N, the reference period taken into account is that between the date of enrolment and August 31 of year N+1,
• In the event that enrolment takes place between January¹ and August 31 of year N+1, the reference period taken into account is that between the date of enrolment and August 31 of year N+1.

The following reference periods are the annual periods between September¹ of year N and August 31 of year N+1.

Each year, on September¹, the Member's loyalty level will be redefined.

For any questions relating to the follow-up of the loyalty level, the Member may contact the Château de Villiers-le-Mahieu(accueil-vlm@lesmaisonsdecampagne.com) or the Maison du Val(accueil-mdv@lesmaisonsdecampagne.com).

Benefits

The benefits granted depend on the Member's level of loyalty.

Level 1: budding epicureans

• A 100 (one hundred) euro gift voucher for a stay at Les Maisons de Campagne.

Level 2: Curious explorers  

• A gift voucher worth 150 (one hundred and fifty) euros towards a stay at one of the Maisons de Campagne.

Level 3: The great escapees

• A gift voucher worth 200 (two hundred) euros towards a stay at one of the Maisons de Campagne ;
• A gift voucher of 100 (one hundred) euros to be used towards a stay in one of the Maisons de Campagne for a friend of the Member, to enable him or her to stay at the same time as the Member in the same Maison de Campagne. The gift voucher for the benefit of the Member's acquaintance must be used for the dates of the Member's stay, otherwise the gift voucher will be lost.
• As well as any special attention reserved for the Member by the Maison de Campagne during his/her stay.

From September^{1st of} year N, the Maisons de Campagne will send Members an e-mail informing them of the availability of gift vouchers, which will be valid until March 15th of year N+1. To receive a dematerialized gift voucher, Members must contact the Maison de Campagne where they last stayed by telephone or e-mail (for the Maison du Val:01.30.86.25.00-accueil-mdv@lesmaisonsdecampagne.com/pour le Château de Villiers le Mahieu:01.34.87.44.25-accueil-vlm@lesmaisonsdecampagne.com). Les Maisons de Campagne reserves the right to request proof of identity from the Member in order to issue the gift voucher. After the March 15th deadline, the Member will no longer be able to redeem the gift voucher with Les Maisons de Campagne.

The stays resulting from these gift vouchers must take place between their issue date and March 15th, subject to availability at the chosen Country House and any restrictions (such as minimum stay) on the dates selected by the Member. By March 16th, no stays can be offered to the Member for the use of his/her gift voucher.

Reservations for the Clé des Champs program must be made by telephone with the reception desk of the Country House chosen by the Member (for the Maison du Val: 01.30.86.25.00/for the Château de Villiers le Mahieu: 01.34.87.44.25).

The advantages listed above are reserved exclusively for the Member and are neither transferable nor deferrable. These benefits and membership of La Clé des Champs may not be exchanged, reimbursed or otherwise compensated in the event, for example, that the Member fails to use said benefits during the periods defined in accordance with the conditions of use listed above.

Nor may the benefits, under any circumstances or in any manner whatsoever, be transferred by the Member to a third party.

The Member benefits from the advantages of the program from the date of joining, for an indefinite period, subject to termination by one of the parties, in accordance with article 1211 of the French Civil Code, in particular by application of the provisions of the "Termination of the program" article.

Modification of Clé des Champs

Les Maisons de Campagne reserves the right, at any time, to modify the General Terms and Conditions, in particular the conditions for awarding loyalty levels and the advantages set out above, or to cancel Clé des Champs altogether.

The Member shall be informed by e-mail no later than thirty (30) days prior to the effective date of such modifications/removal. Modifications shall be deemed accepted by the Member in the absence of any written objection to Maisons de Campagne. In the event of refusal of these modifications, Maisons de Campagne will proceed with the exclusion of the Member.  

Unsubscribe/Cancel program

Unsubscription by Member

The Member may at any time request to be removed from the program directly at the Maison de Campagne reception desk or by sending a request via the Site's contact form.

Unsubscription will be carried out as soon as possible and a confirmation e-mail will be sent. Unsubscription entails the loss of unused benefits from the date of receipt of the unsubscription request.

Exclusion of a Member

The Maisons de Campagne may exclude a Member from the Clé des Champs in the event that the Member fails to comply with his or her obligations under the General Terms and Conditions, which may result in particular from fraudulent behavior on the part of the Member, failure to comply with the conditions of membership of the Clé des Champs (lack of legal capacity, etc.), failure to comply with the general terms and conditions of sale during his or her stay at the Maisons de Campagne, or refusal to accept changes made to the Clé des Champs.

The exclusion will be sent by e-mail. The exclusion of a Member entails the loss of unused benefits as of the date of receipt of the exclusion e-mail.

Personal data-Communication

The Member acknowledges that he/she is fully aware that :

• Membership of Clé des Champs implies acceptance of electronic communications related to the operation and benefits of Clé des Champs ;
• personal data communicated by the Member to the Maison de Campagne where membership was obtained may be stored, processed and transferred to the other Maison de Campagne and to third parties, for the purposes of managing La Clé des Champs.

Under the present terms, it is agreed that the Maison de Campagne within which the membership was carried out, is responsible for processing within the meaning of the applicable regulations, i.e. Regulation (EU) 2016/679 of April 27, 2016 known as the General Data Protection Regulation (GDPR) and Law No. 78-17 Informatique et libertés in its updated version.

As such, Maisons de Campagne undertakes to process the personal data entrusted by the Member in compliance with the provisions set out in the RGPD and in accordance with their data protection policy available here.

Should the Member object to electronic communications from Maisons de Campagne for the management of the Clé des Champs, the Member declares that he/she is fully aware that this could result in the Member being deprived of the benefits granted by the Clé des Champs.

In accordance with article L223-2 of the French Consumer Code, consumers who do not wish to be the subject of commercial prospecting by telephone can register free of charge on a list of opposition to telephone canvassing, notably via the website: www.bloctel.gouv.fr

Responsibility

Les Maisons de Campagne shall not be held liable for any damages arising from or in connection with the benefits of the Clé des Champs.

Les Maisons de Campagne cannot be held responsible for any damage resulting from changes to the General Terms and Conditions or the cancellation of Clé des Champs.

Any fraud or non-compliance with the General Terms and Conditions by a Member may result in his/her exclusion from La Clé des Champs in accordance with the article "Exclusion of a Member", with Les Maisons de Campagne reserving all rights and actions in this regard.

Applicable law - Disputes

The General Conditions are governed by French law.

The Member is hereby informed of the possibility of resorting to a conventional mediation procedure or any other alternative dispute resolution method in the event of a dispute relating to the present contract, under the conditions set out in Title I of Book VI of the French Consumer Code.

After having contacted the customer service department(accueil-vlm@lesmaisonsdecampagne.com or accueil-mdv@lesmaisonsdecampagne.com) to try to resolve the dispute amicably, and in the event of a negative response or the absence of a response within sixty (60) days from the date of referral, the Member may refer the matter to the Médiateur Du Tourisme et du Voyage by e-mail using the referral form available on the website www.mtv.travel or by post to the following address:

Members are also informed of the existence of a European platform for Online Dispute Resolution to which they may have recourse. The Member can access it here.
